With the <\/span>recent<\/span> permanency of the Federal Excise Tax reduction<\/span><\/a>, <\/span>now<\/span> <\/span>is the perfect time to <\/span>take <\/span>your DSP licen<\/span>se<\/span> (or craft spirits <\/span>concept<\/span>)<\/span> to a full-blown distillery operation.<\/span>That said, <\/span>turning a passion for<\/span> craft spirits<\/span> <\/span>into <\/span>a <\/span>successful distillery <\/span>is a giant leap<\/span>. <\/span>Luckily, you have us to serve as your trusted resource in helping you get on your feet \u2013 and way, way beyond.<\/span> <\/span><\/p>\n\n\n\n

L<\/span>et\u2019s start with the basics<\/span>. <\/span> <\/span><\/p>\n\n\n\n

Determine the location of your DSP. <\/strong><\/p>\n\n\n\n

Obviously, you must have a TTB-approved location before you can start distilling. A strategic location can be integral for a variety of reasons. If you\u2019re looking to grow your own ingredients, you\u2019ll need a lot of land. You’ll need to be in an accessible location to receive and distribute supplies and product. Will you have a tasting room? You may want to focus on a highly trafficked location. Building\/use permits and zoning requirements will be subject to state and local regulations.<\/span> <\/span><\/p>\n\n\n\n

 <\/span><\/p>\n\n\n\n

Determine which spirits you’ll produce initially. <\/strong><\/p>\n\n\n\n

To<\/span> <\/span>produce <\/span>whiskey as your sole product<\/span>, <\/span>you <\/span>need <\/span>two things: <\/span>millions of dollars, and time \u2013 several years, to be exact. <\/span>To help bridge the gap between laying down and bottling your delicious whiskey, <\/span>m<\/span>ost new distilleries <\/span>launch with<\/span> vodka<\/span>, <\/span>gin<\/span>, or other <\/span>un-aged spirit, which can<\/span> <\/span>generate<\/span> <\/span>revenue <\/span>while<\/span> <\/span>whiskey ages<\/span>. <\/span>To set <\/span>your <\/span>clear<\/span> <\/span>spirits <\/span>apart <\/span>from the rest, consider what your<\/span> recipes will include<\/span>. <\/span>Some basic questions to start with are:<\/span> <\/span><\/p>\n\n\n\n

a) Is this a <\/span>grain<\/span>-to-bottle process, or are you starting with a high-quality neutral <\/span>grain spirit<\/span> or barreled whiskey<\/span>?<\/span> <\/span><\/p>\n\n\n\n

b) If you<\/span> are<\/span> doing fermentation<\/span>, <\/span>what\u2019s<\/span> the base for your spirit<\/span>: grain, fruit, cane, or something else?<\/span> <\/span><\/p>\n\n\n\n

c) Will you get creative with botanicals and flavor profiles?<\/span> <\/span> <\/span><\/p>\n\n\n\n

d) How are your sourcing decisions affected or influenced by consumer and market trends<\/span>? <\/span>Will your product be o<\/span>rganic? Locally gro<\/span>wn? Sustainably sourced? <\/span> <\/span><\/p>\n\n\n\n

e) Establishing a baseline or guiding principle for your recipes, product line, and marketing strategy is a crucial step to hit the ground running with your new distillery.\u00a0Don\u2019t\u00a0forget that\u00a0all\u00a0formulas\u00a0and labels\u00a0need to be approved by the\u00a0TTB\u00a0before production can start.\u00a0(PS\u00a0\u2013 we offer consulting services for\u00a0this!)\u00a0<\/span><\/p>\n\n\n\n

Determine Your Capital Investment Needs. <\/strong><\/p>\n\n\n\n

I<\/span>t\u2019s<\/span> important to know <\/span>exactly <\/span><\/i>how much capital <\/span>y<\/span>ou are<\/span> going to need up front to ensure long-<\/span> term success, whether <\/span>you\u2019re<\/span> self<\/span>-funding<\/span> or raising capital from private investors or a bank<\/span>.<\/span> <\/span> <\/span>A <\/span> few <\/span>things to <\/span>consider in <\/span>calculat<\/span>ing<\/span> your <\/span>capital needs:<\/span> <\/span><\/p>\n\n\n\n

a) Estimate <\/span>material costs<\/span> based on preferred vendors and <\/span>suppliers.<\/span> <\/span><\/p>\n\n\n\n

b) Define your sales process: are you self-distributing or using a distributor? <\/span> <\/span><\/p>\n\n\n\n

c) Estimate your target profit margins <\/span>and,<\/span> based on distribution, define a t<\/span>arget price<\/span>.<\/span> point for retail, wholesale, or both<\/span>.<\/span> Do<\/span> <\/span>research on <\/span>comparable products<\/span> and how they are positioned in the market<\/span>, both in price point and s<\/span>ales strategy<\/span>.<\/span> <\/span><\/p>\n\n\n\n

d) Estimate <\/span>production capacity and forecast revenue <\/span>accordingly<\/span>.<\/span> <\/span><\/p>\n\n\n\n

e) Identify<\/span> and <\/span>estimate fixed and <\/span>labor and <\/span>overhead <\/span>expenses<\/span>.<\/span> <\/span><\/p>\n\n\n\n

The calculations can be used to g<\/span>enerate a high-level P<\/span>&<\/span>L statement to share with <\/span>investors, to<\/span> obtain bank loans<\/span>,<\/span> or simply to<\/span> use as a guide <\/span>in <\/span>setting up or evaluating operations<\/span>.<\/span> <\/span>The more clearly you understand what will go into starting a new distillery and what will likely <\/span>occur during your first five years of operating, the better you can set yourself up for success <\/span>from day one.<\/span> A P<\/span>&<\/span>L statement is as <\/span>basic <\/span>as it gets \u2013 and may be your ticket to the funding <\/span>you need or <\/span>to <\/span>avoiding <\/span>mistakes in the beginning.<\/span> <\/span><\/p>\n\n\n\n

Define your brand and register your business name. <\/strong><\/p>\n\n\n\n

With <\/span>more and more<\/span> craft distilleries popping up by the week<\/span>, <\/span>th<\/span>oughtful, <\/span>intentional<\/span> and <\/span>unique branding will be key to differentiating your<\/span> product<\/span> from the rest <\/span>and cultivating a loyal <\/span>customer base.<\/span> This is a highly saturated market<\/span>:<\/span> how will you get <\/span>people to pick up your <\/span>bottle of vodka <\/span>over <\/span>other <\/span>brand<\/span>s<\/span>?<\/span> <\/span>Focus on <\/span>\u201c<\/span>shelf appeal<\/span>\u201d<\/span> wh<\/span>en deciding bottle shape, label design, and spirit names.<\/span> Who will <\/span>your<\/span> <\/span>product be tailored <\/span>to?<\/span> <\/span>Is there a specific market segment that <\/span>you\u2019ll<\/span> be <\/span>targeting<\/span> your <\/span>brand<\/span> <\/span>to<\/span>?<\/span> <\/span>Additionally, <\/span>(and we <\/span>know this one might seem obvious) make sure <\/span>to Google and<\/span> triple-check that<\/span> your brand name <\/span>doesn\u2019t<\/span> already exist!<\/span> <\/span><\/p>\n\n\n\n

Apply for your DSP if you have not already, as well as other necessary federal, state and city licenses and permits. <\/strong><\/p>\n\n\n\n

While the regulations, licenses, and permits necessary to start your distillery <\/span>differ<\/span> <\/span> depending on your geographic location, below are the standard licenses to take into <\/span> consideration, no matter where you are.<\/span> <\/span><\/p>\n\n\n\n

Federal:<\/span> <\/span><\/p>\n\n\n\n

Distilled Spirits Plant (DSP): <\/span><\/b>A distilled spirits plant (DSP) may be established to produce, bottle, rectify, process or store beverage spirits.  Examples of beverage distilled spirits include neutral spirits or alcohol (<\/span>i.e.<\/span> vodka or grain spirits), whiskey, gin, brandy, blended applejack, rum, Tequila, cordials and liqueurs (TTB.gov). A DSP must be acquired before any production can begin.<\/span> <\/span><\/p>\n\n\n\n

Business License:<\/span><\/b> All businesses operating in the United States are required to obtain a business license. <\/span> <\/span><\/p>\n\n\n\n

Employer Identification Number (EIN): <\/span><\/b>In order to hire employees in the United States, you will need an EIN. <\/span> <\/span><\/p>\n\n\n\n

Local:<\/span> <\/span><\/p>\n\n\n\n

Certificate of Occupancy: <\/span><\/b>Every business in the food or beverage industry needs a certificate of occupancy. This certificate is subject to local government health and safety regulations.<\/span> <\/span><\/p>\n\n\n\n

Liquor License: <\/span><\/b>Liquor licenses are acquired at the local level and are required before you can begin to sell liquor at any volume.<\/span> <\/span><\/p>\n\n\n\n

The state also regulates what products can be produced and how they can be distributed. Pay close attention to how these regulations vary between state lines.
