The caps specified here are counted <em>after<\/em> hitting the 500,000 gallons specified above:&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Commodity<\/strong>&nbsp;<\/td><td><strong>Rebate<\/strong>&nbsp;<\/td><td><strong>Additional Cap, gal<\/strong>&nbsp;<\/td><td><strong>Max Rebate Amt<\/strong>&nbsp;<\/td><td><strong>Effective Bottle COGS Discount<\/strong>&nbsp;<\/td><\/tr><tr><td>Beer, Cider&nbsp;<\/td><td>$0.045\/gal&nbsp;<\/td><td>15 million&nbsp;<\/td><td>$675,000&nbsp;<\/td><td>355ml: 0.4 cents&nbsp;<\/td><\/tr><tr><td>Wine&nbsp;<\/td><td>$0.045\/gal&nbsp;<\/td><td>15 million&nbsp;<\/td><td>$675,000&nbsp;<\/td><td>750ml: 0.9 cents&nbsp;<\/td><\/tr><tr><td>Spirits &lt; 24% &amp; &gt; 2%&nbsp;<\/td><td>$0.045\/gal&nbsp;<\/td><td>300,000&nbsp;<\/td><td>$13,500&nbsp;<\/td><td>750ml: 0.9 cents&nbsp;<\/td><\/tr><tr><td>Spirits &gt; 24%&nbsp;<\/td><td>$0.045\/gal&nbsp;<\/td><td>300,000&nbsp;<\/td><td>$13,500&nbsp;<\/td><td>750ml: 0.9 cents&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>According to guidance from NYSLA, this credit:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reduces your New York State tax burden, except that you may not eliminate the \u201cMTA surcharge\u201d business tax, nor may it reduce your tax below the fixed dollar minimum tax.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is considered an \u201coverpayment\u201d and <strong>can be<\/strong> <strong>refunded<\/strong> or <strong>applied to the next year\u2019s tax <\/strong>if you have more credit than tax liability.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Applies to \u201cProduction\u201d which is defined further as \u201cBottling\u201d (quantities you report for the credit flow through from the MT-456 report\u2019s \u201cProduced\u201d quantity, which is \u201cBottling\u201d).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>This credit is compelling because it appears to apply <strong>whether you sell in NY or not<\/strong>, and because a distillery can theoretically get as much as $4,517,000 per annum in credits if fully maximized.&nbsp;<\/p>\n\n\n\n<p>No matter what, this is a substantial amount of cash. But if you are competing in the \u201cvalue spirits\u201d world, a credit of $1.27 per bottle is enough to give you a significant competitive advantage, even against producers in states with much lower operating costs.&nbsp;&nbsp;<\/p>\n\n\n\n<p>For reference, the Federal Excise Tax burden on an 80 proof 750ml bottle of spirits is $2.11 for a large producer at the higher $13.34\/PG tax rate.
